It is an unfortunate fact of our society today, but there are many decent and hard working people who have experienced a financial situation that puts too much burden on their finances to survive financially. Situations such as a lost job, reduced hours at work, or pay cut, divorce, a recent disability or a mortgage payment that is beyond their means can leave even the most organized and prepared person in a financial hardship. Once the outflow of money is more the inflow it is easy to wonder how can I get out of this mess before it turns into a financial disaster.

Filing for bankruptcy protection in San Marcos, California may be one option that should be considered. Your San Marcos bankruptcy attorney will be able to evaluate your financial situation and give you guidance on whether they think that bankruptcy is a solution that could be considered. Most bankruptcy attorneys offer a free initial consultation to review your financial data and help you decide if bankruptcy is something you want or need to do.

We suggest that you seek a qualified San Marcos bankruptcy attorney prior to taking a second mortgage or equity loan on your home to pay an unsecured creditor such as a credit card company prior to speaking with a San Marcos bankruptcy attorney. The reason is that your home and any mortgage on that home is a secured debt, while a credit card is an unsecured debt. In most Chapter 7 bankruptcy proceedings in San Marcos a person’s unsecured debt is wiped out. Prior to borrowing any money from the equity in your home or withdrawing any money from your retirement accounts it would be wise to speak to a qualified San Marcos bankruptcy lawyer.

If you are struggling with high debt, receiving calls from creditors or collection agencies, or facing foreclosure, garnishment of wages, or repossession of property, filing for bankruptcy may provide you with solutions.

Filing for bankruptcy is an important decision that has significant implications for your life. But when mounting debt begins to feel unmanageable, bankruptcy can provide relief.

The goal of bankruptcy is to get a fresh start by discharging your debts while keeping the property that you are legally entitled to protect.

Bankruptcy law allows debtors, who are unable or partially unable to pay outstanding debts, to rid themselves of these debts and obtain a fresh start. Laws can affect a debtor seeking to file for bankruptcy, and an attorney can help you understand how bankruptcy laws apply to you.

Experienced bankruptcy lawyers can help you evaluate whether you should pursue a bankruptcy as well as the Chapter under which to file. Bankruptcy lawyers can also help end harassing phone calls from debt collectors and evaluate available legal options when facing a home foreclosure.

Automatic stay: An injunction that automatically stops lawsuits, foreclosures, garnishments, and most collection activity against the debtor the moment a bankruptcy petition is filed.

Unsecured claim: A debt for which credit was extended based solely upon the creditor’s assessment of the debtor’s future ability to pay, rather than on a special assurance of payment.

In general, assets that you own prior to filing for bankruptcy are called pre-petition assets. Some of these valuable assets maybe used to pay those debts you owed before filing bankruptcy, called pre-petition debts. Normally, any assets that you acquire after your bankruptcy is filed are yours, called post-petition assets and your pre-petition creditors cannot take them. By the same token, any liabilities you incur after the bankruptcy was filed, called post-petition liabilities, are not normally discharged in your bankruptcy proceeding. This may change somewhat in a chapter 13 case.

There are many reasons for financial difficulties. We understand money problems can be emotionally wrenching and seriously damage family relations. Give Mashney Law Offices a call today and let us help end the stress and get you and your family a fresh start (800) 555-6655.

What is the difference between a Chapter 7 and a Chapter 13 in UT?
Chapter 7

Chapter 7 bankruptcy is what people usually think of when they think of bankruptcy. Chapter 7 bankruptcy is a liquidation. When you file a Chapter 7 bankruptcy a trustee is assigned to administer your case. The trustee will evaluate your property to determine if anything can be liquidated to pay creditors. Bankruptcy laws allow you to keep certain property from being taken and used by the trustee. We can let you know which items are protected from being taken.

Chapter 13

A Chapter 13 bankruptcy is also known as a reorganization. People filing Chapter 13 are allowed to keep all of their assets. When you file a Chapter 13 you propose a Plan to re-pay all or a portion of the debt you owe. Plans are required to last from 3 to 5 years. Similar to a Chapter 7, a Trustee is assigned to administer your case in a Chapter 13. The Chapter 13 Trustee is in charge of receiving your monthly Plan payments and distributing funds to your creditors. The amount of your Plan payment will depend upon what you owe, what property you choose to keep, and your net income after paying your living expenses.

Jory L. Trease, Inc. can help. We’re based in Salt Lake City and have a cutting-edge online process that allows you to work with us easily from anywhere in Utah. Certainly it’s nice to be able to work with us in person, but the added benefit of being able to take care of details, provide information, and ask questions at the push of a button, on your own schedule… simply can’t be beat when it comes to efficiently taking care of business without having to put your life “on hold”.
